Terms of Service

The terms governing use of SimuClinician.

1. Acceptance of Terms

By accessing or using readyClinician (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Educational and Simulation Purposes Only

The Service provides simulated Objective Structured Clinical Examinations (OSCEs) and interactive voice agents for medical education and training.

No Medical Advice: The Service does not provide medical, diagnostic, treatment, or prescriptive advice.

Not a Substitute for Professional Judgment: The Service is not a substitute for professional medical training, supervision, or the independent judgment of a qualified healthcare provider. You agree never to use the Service, or any output generated by the Service, to make real-world clinical decisions or provide patient care.

3. Artificial Intelligence and Output Accuracy

The Service utilizes generative artificial intelligence, large language models, and automated voice agents to dynamically generate responses and scenarios. By using the Service, you acknowledge and agree that:

  • Inherent Inaccuracies: AI systems are inherently probabilistic and may generate output that is inaccurate, misleading, fabricated (i.e., "hallucinations"), or logically inconsistent.
  • User Verification: You are solely responsible for critically evaluating and verifying any information, feedback, or simulated clinical guidance provided by the AI agents before relying on it for any educational or study purposes.
  • No Guarantee of Quality: We make no representations or warranties regarding the accuracy, reliability, completeness, or educational validity of the AI-generated outputs.

4. Disclaimer of Warranties ("As Is" Clause)

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall the developers, owners, or affiliates of the Service be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (A) your access to or use of or inability to access or use the Service; (B) any conduct or content of any third party or artificial intelligence agent on the Service; or (C) any errors, inaccuracies, or omissions in any content generated by the Service. In no event shall our aggregate liability for all claims relating to the Service exceed the greater of one hundred U.S. dollars ($100.00) or the amount you paid us in the past twelve months.

6. Indemnification

You agree to defend, indemnify, and hold harmless the developers and operators of the Service from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (A) your use of and access to the Service; (B) your violation of any term of these Terms of Service; or (C) your reliance on any AI-generated output for real-world medical or clinical application.

7. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also revise these Terms from time to time. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
